Terms of Service

1. Acceptance of Terms

By accessing or using the Applicare platform, arcturustech.com, or any related services provided by Arcturus Technologies, Inc. ("Arcturus"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

Arcturus provides AIOps and full-stack observability services through the Applicare platform, including AI-powered monitoring, tracing, and automation capabilities. Service features and availability are subject to change.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Arcturus immediately of any unauthorised use of your account. Arcturus is not liable for any loss resulting from unauthorised account access.

4. Acceptable Use

You agree not to: (a) violate any applicable laws or regulations; (b) transmit malicious code or interfere with platform integrity; (c) attempt to gain unauthorised access to any system; (d) use the services to infringe third-party intellectual property rights; or (e) resell or sublicense the services without written permission.

5. Intellectual Property

All content, software, and technology comprising the Applicare platform — including patents US App 17/842,103, US App 17/901,447, and US Patent 11,782,739 — are the exclusive property of Arcturus Technologies, Inc. Nothing in these terms grants you ownership of any Arcturus intellectual property.

6. Confidentiality

Both parties agree to treat as confidential any non-public information disclosed in connection with these terms, and to use such information only for the purposes of the service relationship.

7. Limitation of Liability

To the maximum extent permitted by law, Arcturus shall not be liable for any indirect, incidental, special, or consequential damages. Arcturus's total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

8. Disclaimer of Warranties

The services are provided "as is" without warranty of any kind, express or implied. Arcturus does not warrant that the services will be uninterrupted, error-free, or free of security vulnerabilities.

9. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law provisions. Disputes shall be resolved in the courts of Fairfax County, Virginia.

10. Changes to Terms

Arcturus reserves the right to modify these terms at any time. Changes become effective upon posting. Continued use of the services constitutes acceptance of the revised terms.
